The ARTAVIA Affiliates has prepared this privacy policy (“Privacy Policy”) to explain to you how we collect, use, and share information we obtain through your use of our  website www.simplyARTAVIA.com (the “Site”) and, if applicable, online services (“Services”) that are operated by or controlled by the ARTAVIA Affiliates. This Privacy Policy only covers information collected through the Site and Services. We do not sell, rent or trade email lists with other companies for marketing purposes.

1. Information You Choose To Submit
You can visit the Site without telling us who you are or revealing any information by which someone could identify you as a specific, identifiable individual (such information, “Personal Information”). If, however, you wish to register to receive more information about us, our community and partners, you are required to provide certain Personal Information (e.g., your name, e-mail address, and phone number), and the address of your home in ARTAVIA (Non-Personal Information together with Personal Information being collectively called “Data”). We use your Data to fulfill your requests for Services, to improve our Services, to contact you from time to time about us and our activities and events, and as otherwise described in this Privacy Policy. We may collect additional information about you  if you choose to provide such information  such as information about your preferences and interests.  If we combine your Non-Personal Information with your Personal Information, we will treat the combined information as your Personal Information under this Privacy Policy.

We may automatically collect certain information from your web browser when you interact with the Site to help us understand how our users use our Site and to target activities to you (which we will refer to in this Privacy Policy collectively as “Usage Data”). The ARTAVIA Affiliates will not sell, distribute or share any Personal Information you provide to any outside businesses or organizations.  As a registered user of simplyARTAVIA.com and a resident of the community,  any Personal Information we possess will be used for the sole purpose of administering the relationship between you  and the ARTAVIA Affiliates. 
Any Data or other information you choose to submit in communities or blogs on our Site may be read, collected and used by others who visit these blogs. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any information that you post to those areas.
7. Users Residing Outside of the United States of America and Consent to Transfer
The Services are operated in the United States of America. If you are located in another jurisdiction, please be aware that information you provide to us will be transferred to and processed in the United States of America. By using the Site or providing us with any information, you consent to this transfer, processing, and storage of your information in the United States of America, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen.
8. Choice/Opt-Out From Communications
We offer you the opportunity to eliminate your communications from us. Even after registering to our website, users may elect to cancel their simplyARTAIVA.com registration by emailing lifestyle@simplyARTAVIA.com.  Please note that opting out of simplyARTAVIA.com means that opt you out of receiving important business communications related to your current relationship with us, such as communications about your event registrations, and will have access to the Site revoked.  This does not apply to the ARTAVIA Affiliates communications; each Affiliate will need to be contacted should you wish to stop receiving information from them as an individual.  
9. Retention Periods and Deletion
We will retain your personal information to the extent necessary to reasonably serve customer relations, to meet our compliance and legal obligations, to enhance security and fraud prevention. We determine the appropriate retention period for the data on the basis of the amount, nature and sensitivity of your data processed, the potential risk of harm from unauthorized use or disclosure of your data and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation).
If you would like to modify or delete from our database any Personal Information you previously submitted to us, please let us know by emailing lifestyle@simplyARTAVIA.com. Please note that any Personal Information that we have copied may remain in back-up storage for some period of time after your request.

IV.             PASSWORDS
You may be assigned an account and password in order to access certain areas of this website. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to immediately notify the management company for ARTAVIA Management of any unauthorized use of your password or account or any other breach of security. The ARTAVIA Affiliates cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
 
V.               USER SUBMISSIONS
Any information, data, text, photos or content submitted for posting on this website will be considered Non-Personal Information, non-confidential and non-proprietary and you warrant and represent that your submitted item is your own original work, that you alone own copyright, that it is an authentic and accurate depiction of the subject matter presented and that no other party has any right, title, claim or interest. The ARTAVIA Affiliates will have no obligations with respect to such submissions. The ARTAVIA Affiliates and its designees will be free to copy, disclose, distribute, reproduce, incorporate and otherwise use your submission.
These Terms and Conditions, together with any documents expressly referred to in them, contain the entire agreement between us relating to the subject matter covered and supersede any previous agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of the Terms and Conditions. In agreeing to these Terms and Conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this agreement.
